THE PRINCIPLE PRO HOMINE AS INSTRUMENT OF INTEGRAL PROTECTION THE HUMAN BEING IN THE WORK RELATIONSHIP

Summary: | This article aims to present a response to the three questions about the protection of man in labor relations: what is it to be protected? Whom to be protected? And how to be protected? In an attempt to provide answers to these three questions, starting from the current Brazilian legislative context, it will seek to comply with international legislation, treaties and conventions ratified by Brazil. In the process of this reflection, the principle pro homine, which is inscribed in several international diplomas, notably in art. 29b of the American Convention on Human Rights (ACHR), art. 4th the Protocol of San Salvador, among others, will be both the guiding thread and the way that will be found to give satisfactory answer to all the structural structural reforms that are being faced in our legislation. The principle of pro homine, well understood and implemented, will enable the full protection of the human being, for guiding the lawyers and legislators in applying standards that are more protective range in the working relationship, taking the man not as a mere employee but as one which, in the working relationship, develops as a human being, person. |

En el intento de traer respuestas a esas tres cuestiones, partiendo del contexto legislativo brasileño actual, buscará supedal en la legislación internacional, en los tratados y convenciones que Brasil ratificó. En el camino de esa reflexión, el principio pro homine, que se encuentra inscrito en diversos diplomas internacionales, notadamente en el art. 29b de la Convención Americana de Derechos Humanos (CADH), en el art. 4º del Protocolo de San Salvador, entre otros, será tanto el hilo conductor como el camino que se encontrará para dar respuesta satisfactoria a todas las reformas estructurales laborales que se vienen enfrentando en nuestra legislación. El principio pro homine, bien entendido y aplicado, posibilitará la tutela integral del ser humano, pues orienta a los juristas y legisladores en la aplicación de normas que tienen mayor alcance protector en la relación de trabajo, tomando al hombre no como un mero trabajador, sino como aquel que, en la relación de trabajo, se desarrolla como ser humano, persona.Este artigo visa a apresentar uma resposta às três indagações sobre a tutela do homem nas relações de trabalho: o que é estar protegido? De quem estar protegido? E como estar protegido? Na tentativa de trazer respostas a essas três questões, partindo-se do contexto legislativo brasileiro atual, buscará supedâneo na legislação internacional, nos tratados e convenções que o Brasil ratificou. No caminho dessa reflexão, o princípio pro homine, que se encontra inscrito em diversos diplomas internacionais, notadamente no art. 29b da Convenção Americana de Direitos Humanos (CADH), no art. 4.º do Protocolo de San Salvador, entre outros, será tanto o fio condutor quanto o caminho que se encontrará para dar resposta satisfativa a todas as reformas estruturais trabalhistas que vêm sendo enfrentadas em nossa legislação.
