Observa-se poucas mudanças nas normas que dizem respeito às regras e limites para as Áreas de Preservação Permanente (APP) e Reserva Legal (RL), porém para facilitar o cumprimento da lei, verifica-se a criação de alguns institutos: Cadastro Ambiental Rural (CAR); Sistema Nacional de Cadastro Ambiental Rural (SICAR); Programa de Regularização Ambiental (PRA); dentre outros. Ainda que todas as propriedades rurais estejam subordinadas ao cumprimento da mesma legislação, o novo regramento inovou com normas mais brandas para aqueles que detém imóveis com até quatro módulos fiscais, além de adotar um critério jurídico distinto em relação ao aspecto temporal, a partir da promulgação do Decreto nº 6.514/2008, isto é, 22 de julho de 2008. Assim, estabeleceram-se dois caminhos distintos: um de tolerância para as condutas lesivas ao ambiente perpetradas até o dia 22 de julho de 2008, e outro rígido para os atos praticados a partir dessa data. Com isso, nota-se a existência de um tratamento diferente para o pequeno produtor rural, situação que acabou por favorecer, igualmente, os médios e até mesmo os produtores mais expressivos. Conclui-se que a mudança foi negativa em relação a não obrigatoriedade de recomposição da RL para aqueles imóveis que possuem menos de quatro módulos rurais, e, também, com a alteração na medição da APP e o cálculo da APP na RL. Porém, as alterações também trouxeram a criação de instrumentos, tal como o CAR e o PRA, que parecem ser realmente efetivos na fiscalização e controle dos imóveis ruraisAbstract: The new forest law reformulated the rules on forest protection and use, as well as other forms of native vegetation, thus creating instruments capable of permitting the environmental regularization of rural properties. There are few changes in the rules that pertain to the rules and limits for the Permanent Preservation Areas (PPA) and Legal Reserve (RL), but to facilitate compliance with the law, there are some institutes: Rural Environmental Registration; National System of Rural Environmental Registration; Environmental Regularization Program; among others. Although all rural properties are subject to compliance with the same legislation, the new regulation innovated with milder rules for those who own property with up to four tax modules, in addition to adopting a different legal criterion in relation to the temporal aspect, from the enactment of Decree No. 6,514 / 2008, that is to say, July 22, 2008. Thus, two distinct paths were established: one of tolerance for conduct harmful to the environment perpetrated until July 22, 2008, and another rigid for acts from that date. This shows that there is a different treatment for the small rural producer, a situation that has also favored the middlemen and even the most expressive producers. It was concluded that the change was negative in relation to the non-obligatory recomposition of RL for those properties that have less than four rural modules, and also with the change in the measurement of the PPA and the calculation of the PPA in the RL.
