Adequate, clear and true information may appear as one of the main consumer protection instruments, against the flow of controversial information in contemporary society. The Bill no. 4,148 / 2008, pending in the Senate as PLC n. 34/2015, affront that right to propose to amend the labeling and identification of genetically modified foods in Brazil. Only provided with full information the consumer can exercise conscious consumption: critical, free and sustainable. To achieve this purpose, it will be used the bibliographical, documentary and legislative methodology.O presente artigo versa sobre a essencialidade do direito fundamental à informação na sociedade de consumo. A informação adequada, clara e verdadeira pode figurar como um dos principais instrumentos de proteção do consumidor, frente à fluidez de informações controversas na sociedade contemporânea. O Projeto de Lei n. 4.148/2008, em tramitação no Senado Federal como PLC n. 34/2015, afronta esse direito, ao propor a alteração da rotulagem e identificação de alimentos transgênicos no Brasil. Somente munido com a informação plena o consumidor poderá exercer o consumo consciente: crítico, livre e sustentável.
