O Serviço Social no Sistema de Proteção à Infância em Perigo, em Portugal

Na presente investigação foi analisada a forma como evoluiu o sistema de proteção à infância e juventude, em Portugal, no que respeita: tanto aos conceitos que definiam criança em perigo, como às instituições que as acolhiam e protegiam e as medidas a elas aplicadas. A par disto, procurou-se entender que de forma o Serviço Social acompanhou essa mesma evolução e qual é hoje a sua representatividade nesse sistema, delimitando o nosso estudo entre os anos de 1911 e 2018. Tendo em conta os objetivos definidos para a investigação, utilizámos o método de pesquisa que melhor se adequasse à finalidade pretendida. Recorremo-nos assim, da pesquisa documental, em duas vertentes: tanto na análise de conteúdo categorial, em especial, da legislação, que nos permitiu dar conta das evoluções atrás enunciadas, como na análise aos relatórios anuais de atividade publicados pela Comissão Nacional de Promoção dos Direitos e Proteção das Crianças, fonte esta que nos permite identificar a representatividade do Serviço Social no atual sistema, através das trezentas e nove Comissões de Proteção de Crianças e Jovens existentes em Portugal, tendo para isso, recorrido a um tipo de leitura estatística descritiva dos dados neles apresentados, reunindo, posteriormente, todos esses dados em gráficos, o que permitiu analisar detalhadamente, a evolução e presença do Serviço Social nessas mesmas CPCJ. Concluímos que o sistema de proteção à infância em Portugal, nem sempre se pautou pelos princípios de hoje. Vários foram os desenvolvimentos no que respeita ao conceito e definição de criança em perigo, tendo demorado diversas décadas até ao separar efetivo de crianças em perigo e de crianças infratoras. Também o próprio sistema de proteção sofreu diversas alterações e reformulações nos cento e sete anos que separam a primeira Lei de Proteção, da última publicada, assim como o Serviço Social, que apesar de sempre presente nesse mesmo sistema, demorou até ser reconhecido como a profissão académica que é hoje. / In this research, the way in which the child and youth protection system evolved in Portugal was analysed: both the concepts that defined children in danger and the institutions that welcomed and protected them and the measures applied to them. In addition, we tried to understand how the Social Work followed this same evolution and what its representativeness in this system is today, delimiting our study between the years 1911 and 2018. Taking into account the objectives defined for the research, we used the research method that best suited the intended purpose. Let us remember, therefore, the documentary research, in two aspects: both in the analysis of categorical content, especially legislation, which allowed us to report on the above developments, and in the analysis of the annual activity reports published by the National Commission for the Promotion of the Rights and Protection of Children, a source which allows us to identify the representativeness of Social Work in the current system, through the three hundred and nine Commissions for the Protection of Children and Young People in Portugal, and for this purpose, used a type of descriptive statistical reading of the data presented in them, later gathering all this data in graphs, which allowed a detailed analysis of the evolution and presence of Social Work in these same CPCJ. We concluded that the child protection system in Portugal has not always been guided by today's principles. There have been a number of developments with regard to the concept and definition of children in danger, and it has taken several decades to effectively separate children in danger from offending children. The protection system itself also underwent several changes and reformulations in the one hundred and seven years that separate the first Protection Law, from the last one published, as well as the Social Service, which despite always being present in the same system, took until it was recognised as the academic profession it is today.
