This study is divided into two parts: the first part corresponds to the complex theme of the institute of prohibited evidence and the second part corresponds to the fruits of the poisonous tree doctrine and all its conclusions.In the first part we address the definition, concept and nature of the prohibitions of evidence in the context of the Portuguese legal system. We proceed to the legal framework, drawing the distinction between prohibitions of evidence and prohibition rules and we also deal with the various types of prohibitions of evidence. Having said that, we go through the regime of prohibitions of evidence and draw its regime according to the regime of procedural nullities, where we establish the autonomy between them, and there are two major doctrines in this regard: the doctrine of complete autonomy and dogmatic autonomy Finally, we take a position on the extent of that autonomy.The second part is composed of two chapters. In the first, we introduce the distance effect as a corollary of the institute of prohibitions of evidence. We contextualize this figure in the North American legal system, where it was born and we travel to the German legal system, where we analyze the conciliatory positions: case-oriented position; the sphere of protection of the norm as guidance and the positions based on hypothetical paths of investigation.In the last part of this chapter we analyze the problem in the Portuguese jurisprudential context, citing several judgments to that effect.A presente dissertação versa sobre o efeito-à-distância das provas proibidas no ordenamento jurídico português, e dos seus eventuais limites. Este estudo encontra-se dividido em duas partes: a primeira parte corresponde ao complexo tema do instituto das provas proibidas e a segunda parte corresponde ao efeito-à-distância e todas as suas ilações.Na primeira parte abordamos a definição, conceito e natureza das proibições de prova no contexto do ordenamento português. Prosseguimos para o enquadramento jurídico, traçando a distinção entre proibições de prova e regras de proibição e tratamos ainda dos vários tipos de proibições de prova. Posto isto, enveredamos pelo regime das proibições de prova e desenhamos o seu regime em função do regime das nulidades processuais, onde estabelecemos a autonomia entre eles, há duas grandes doutrinas neste sentido: a a doutrina da autonomia completa e autonomia dogmática.Por fim, tomamos posição acerca da extensão dessa mesma autonomia.Na segunda parte é composta por dois capítulos. No primeiro, introduzimos o efeito-à-distância como corolário do instituto das proibições de prova. Contextualizamos esta figura no ordenamento jurídico norte-americano, onde nasceu e viajamos até ao ordenamento jurídico germânico, onde analisamos as posições conciliatórias: posição norteadas para o caso concreto; a esfera da proteção da norma como orientação e as posições baseadas nos percursos hipotéticos de investigação.No segundo capítulo debruçamos nos sobre os três limites do efeito-à-distância propostos pelo direito norte-americano, onde analisamos os casos que originaram este instituto.
