Para tanto, parte-se de um estudo de direito comparado da liberdade religiosa, da interpretação do seu conceito, insculpido nos artigos 9.º da CEDH e 10.º da CDFUE, à luz da jurisprudência do TEDH e do TJUE. Além disso, também se estuda o artigo 1.º do Protocolo n.º 1.º adicional à CEDH, referente ao direito dos pais de educarem os seus filhos de acordo com as suas convicções políticas e religiosas, em que se apresenta o caso Lautsi v. Itália. Em seguida, busca-se examinar a laicidade francesa e o secularismo turco, apontando as suas diferenças, e principalmente, a maneira como o Islão tem interferido nos seus conceitos nos dias de hoje. Posteriormente, menciona-se sobre os principais desafios que a Europa tem enfrentado nos últimos tempos: o uso do véu islâmico, a partir de julgados do TEDH (Leyla Sahin v. Turquia; Dogru v. França e El Morsili v. França) e o crescimento da islamofobia. Após, trataremos sobre a aplicação do princípio da laicidade em França e a sua ligação com o Islamismo: o uso do hijab só é permitido nas universidades públicas francesas, desde que não se exerça qualquer tipo de intolerância, apto a interferir nas crenças dos outros indivíduos. Adiante faremos menção ao case study Osmanoglu e Kocabas v. Suíça. Por último, mencionaremos a utilização do véu islâmico pelas professoras presente nos casos Dahlab v. Suiça e Kurtulmus v. Turquia, julgados pelo TEDH.This paper analyzes the impact of the growing number of Muslim immigrants on the current European scene in legal and cultural terms. To this end, it is based on a comparative law study of religious freedom, on the interpretation of its concept, as set out in Articles 9 of the ECHR and 10 of the CDFUE, in the light of the case-law of the ECtHR and the ECtHR. In addition, article 1 of Protocol No. 1 in addition to the ECHR, concerning the right of parents to raise their children in accordance with their political and religious convictions, in which is presented the Lautsi case v. Italy. It then seeks to examine French secularism and Turkish secularism, pointing out their differences, and above all, the way in which Islam has interfered in its concepts these days.The main challenges that Europe has faced in recent times are the use of the Islamic veil, following the judgments of the ECHR (Leyla Sahin v. Turkey, Dogru v. France and El Morsili v. France) and the growth of Islamophobia. Afterwards, we will deal with the application of the principle of secularity in France and its connection with Islam: the use of hijab is only permitted in French public universities, provided that no intolerance is practiced, capable of interfering with the beliefs of other individuals . Later we will mention the case study Osmanoglu and Kocabas v. Switzerland. Finally, we will mention the use of the Islamic veil by the teachers present in the Dahlab v. Switzerland and Kurtulmus v.
