O conceito de Pooling and Sharing (P&S), à semelhança da Smart Defence, tem sido apresentado como uma solução para os efeitos da crise económica e financeira nos orçamentos de defesa e nas capacidades militares da União Europeia, visando a eliminação de duplicações e a edificação de capacidades integradas. Parece possível aplicá-lo bilateralmente com Espanha atendendo à proximidade geográfica. Contudo, levantam-se questões relativas à História, às realidades geopolíticas, à especificidade das relações peninsulares e aos interesses nacionais. O Trabalho investiga a temática da mutualização de capacidades militares através do P&S, com o intuito de contribuir para uma estratégia de relacionamento com Espanha. A investigação iniciou-se pelo enquadramento do problema e a conceptualização do P&S multilateral. Seguiu-se a caracterização das relações luso-espanholas no passado recente, assim como as suas realidades geopolíticas e as condições para a implementação de iniciativas de P&S. Desenvolveu-se um racional para identificação das Funções Essenciais das Forças Armadas e a definição das Capacidades de Ação Militar Crítica, vedadas a qualquer iniciativa de P&S, tendo em vista a posterior identificação de iniciativas de P&S com Espanha, aceitáveis e exequíveis na perspetiva do interesse nacional. A investigação completa-se com a análise das implicações jurídico-constitucionais da adesão a iniciativas de P&S com Espanha. Da investigação resulta a clarificação do conceito de P&S e das consequências da sua aplicação para a soberania dos Estados, a caracterização das relações luso-espanholas no âmbito da defesa e as condições para a implementação do P&S. Resulta também uma classificação das Funções Essenciais das Forças Armadas e a definição das Capacidades de Ação Militar Crítica, como núcleo duro das capacidades que afetam diretamente a soberania do Estado, a assegurar autonomamente, não sendo passíveis de P&S. Chegámos à conclusão que, excluindo as Capacidades de Ação Militar Crítica, o P&S com Espanha é aplicável a capacidades partilháveis sem dependências mútuas, evitando-se a especialização e integração e garantindo-se a polivalência das Forças Armadas. Concluímos, finalmente, que a adesão a projetos de mutualização de capacidades militares com Espanha deve ser acompanhada de uma análise das suas implicações constitucionais. Abstract: The Pooling and Sharing (P&S) concept like Smart Defence has been presented as a solution for the economical and financial crisis pressure on the European Union (EU) defense budget and military capabilities, by aiming the abolition of duplications and the development of integrated capabilities. It seems possible to apply it bilaterally with Spain, due to the geographic proximity. However, questions related to History, geopolitics, the peninsular relations and national interests are raised. This paper investigates the mutualization of military capabilities through the P&S concept, which is in development in the EU, and generates contributions for a cooperation strategy with Spain. The investigation began with the set up of the problem and the conceptualization of the multilateral P&S. In a second phase, the characterization of the Portuguese-Spanish relations in the recent past, as well as their geopolitics, and the accomplishment conditions to the P&S initiatives. An approach to the classification of the Essential Functions of the Armed Forces and the definition of the Critical Military Action’s Capabilities, sealed to any P&S initiative, was developed. Both procedures were useful, aiming later identification of initiatives with Spain, adequate and feasible, regarding the national interests. The investigation is completed with the analysis of the legal-constitutional implications of the eventual adhesion to the P&S initiative with Spain. From this study results the clarification of the P&S concept and consequences of its application for Nations sovereignty, the characterization of the Portuguese-Spanish relations in terms of Defence and the conditions for the implementation of P&S. It also led to a classification of the Essential Functions of the Armed Forces and the definition of Critical Military Action’s Capabilities, as a core of the capabilities that directly affect the sovereignty of the Nation, thus to be assured autonomously, and not suitable to P&S. We came to the conclusion that, excluding the Critical Military Action’s Capabilities, the P&S with Spain is appropriate to capabilities without raising mutual dependencies, avoiding the specialization and integration and assuring the polyvalence of the Armed Forces. We, finally, conclude that the implementation of projects for the mutualization of the military capabilities with Spain can compromise the Constitution, and therefore require specific attention in this domain.
