Esta questão tem vindo a ser muito discutida tanto a nível doutrinal como principalmente a nível jurisprudencial. Aliás, de tal forma debatida que se encontra atualmente nos Plenos Pendentes do Supremo Tribunal de Justiça.Assim se “ as condutas que o agente tende a repetir são idênticas durante um determinado período temporal mais ou menos alargado” como é que devem ser classificadas?· Serão apenas um acréscimo ao crime já consumado desde a prática do primeiro ato ilícito? Ou · Serão cada uma delas , uma nova consumação material ainda que absorvida na mesma unidade resolutiva?Esta dissertação pretende principalmente chegar a uma resposta à questão acima apresentada, através da exposição dos argumentos de cada uma destas posições, através da análise da natureza do crime de tráfico de estupefacientes bem como da determinação do momento em que este ilícito típico se encontra consumado.Currently, the crime of drug trafficking, provided for Article 21 and following of Decree-Law No. 15/93, continues to be the subject of diverse discussion both at a doctrinal and jurisprudential level, namely on the nature of the aforementioned and its consummation.This dissertation starts from a problem that we come across in Criminal Law classes: if the crime of drug trafficking is considered a single crime, despite its unfolding in several conducts, which, if considered separately, could fulfill the legal type of crime, when is it the exact moment of consummation - the date on which the practice of the various acts began or the date on which the last act took place?After some extensive research, I discovered that there is no unanimity in the answer. This is an issue that has been much discussed at a doctrinal level and mostly at a jurisprudential level.
