Começaremos por um breve afloramento ao pressuposto processual do interesse em agir, seguindo-se o estudo sobre o instituto da reconvenção, o estudo sobre a compensação para que por fim nos seja possível uma reflexão sobre a problemática, fazendo uma análise crítica às teses defendidas na doutrina portuguesa, nomeadamente, a tese da compensação-exceção, da compensação-reconvenção e da compensação-reconvenção híbrida. Por último, após exposição da solução apresentada pelo legislador, procederemos à reflexão do problema que a atual redação do artigo sofre nas Ações Especiais para Cumprimento de Obrigações Pecuniárias Emergentes de Contratos.In view of the huge controversy that has long been present in the Portuguese doctrine as to whether compensation should be obtained by way of an inadmissibility or by a counterclaim, this subject deserves further consideration after the wording that the Portuguese legislator has assigned to Article 266 (1) c) (formerly 274 (2) (b)), which intended to resolve the problem, but far below what was necessary to reach a peaceful resolution. We will start by briefly outlining the absolute bar of the legal interest in bringing proceedings, followed by the study on the counterclaim legal concept and on compensation, so that we may finally meditate about the matter, constructing a critical analysis of the theses defended in the Portuguese doctrine, namely the theory of compensation-exception, compensation-counterclaim and hybrid counterclaim.
