Direito. - ISSN 2182-4118. - S. 2, n. 17 (2017). - p. 95-120O Código Civil de 1966 foi elaborado no contexto político e ideológico de um regime político autoritário, conservador e tradicionalista, cujas grandes orientações se encontravam estabelecidas na Constituição de 1933. A Revolução de 25 de Abril representou, em múltiplos aspectos, uma ruptura com esse regime e deu origem a um quadro institucional muito distinto, marcado, antes do mais, pela natureza democrática do novo regime e pelo respeito pelos direitos fundamentais dos cidadãos. Tão profundas alterações não poderiam deixar de se reflectir no Código Civil. É precisamente sobre as mais significativas dentre elas, umas impostas pela nova lei fundamental e outras por ela permitidas, que o presente artigo se debruça.The 1966 Portuguese Civil Code was prepared and approved in the political and ideological context of an authoritarian, conservative and traditionalist political regime, whose foundations were laid down by the 1933 Constitution. The "25 of April" Revolution changed dramatically that situation and gave birth to a democratic regime, founded, namely, in the respect for the fundamental rights and freedoms. Such changes, sometimes imposed by the new Constitution and sometimes allowed by it, had also profound consequences on the Civil Code.
