Summary: The intent with this study is to discuss what is considered to be the main questions concerning government contracting of legal services, providing a critical analysis of the subject, in addition to citing doctrinal understanding and legal precedents from the Supreme Court, the Superior Court of Justice and the Courts of Accounts. All of this, in order to demonstrate the practical difficulties faced by public administrators. Initially, it will be discussed the limits and possibilities regarding government outsourcing, especially outsourcing of legal services, taking into consideration national Laws 13.429/2017 and 13.467/2017. It will also be discussed the exceptions to competitive bidding and its requirements foreseen under Laws 8.666/93 and 13.303/2016, when it will be explored important aspects relating to singularity of the object and professional with notorious specialization. Finally, in light of the particularities of the legal profession, it will be examined if the bidding process is really suitable for contracting legal services, especially the use of reverse auction modality and lowest price bids

Pretende-se demonstrar as dificuldades práticas enfrentadas pelo administrador. Inicialmente, serão abordados os limites e possibilidades de sua terceirização, levando-se em conta o advento das Leis n. 13.429/2017 e 13.467/2017. Cuidar-se-á das hipóteses de inexigibilidade de licitação fundamentadas nos artigos 13 c/c 25 da Lei n. 8.666/93 e 30 da Lei das Estatais, abordando aspectos importantes relativos à singularidade do objeto, notória especialização do profissional e inviabilidade de competição.
