The proposed study focuses on the procedure of the early production of evidence, specifically in the context of contracts containing an arbitration clause, under the perspective of the Superior Court of Justice (STJ) in the judgment of Special Appeal No. 2,023,615/SP. The analysis will address the elements of prejudice and suitability in the reasoning adopted by the Superior Court, which has served both as a basis for the consolidation of case law on the matter and as a reference for the amendment of internal regulations of Brazilian arbitral institutions. This study is grounded on two starting points: arbitral jurisdiction and the early production of evidence. These two themes will serve as the foundation for the present work, which will explore their intersection and examine the legal and jurisprudential issues involved, as well as their practical application
