The Importance of regulating the use of artificial intelligence in smart cities

Summary: The article presents the results of research developed from September 2023 to May 2024 that analyzed the impact of artificial intelligence on current life and its impact on the management of smart cities. One adopted by reference the European normative act and the debate that is in progress in the Brazilian Legislative Power, among them the Bill 2.338/2023. The objective of the text is to describe the most recent panorama and report the existing concerns regarding data protection and citizens in this new scenario. It defends the importance of inserting technologies considering respect for the human being, from the perspective of philosopher Adela Cortina and the paradigm of democratic digital governance. One conducted an exploratory research, considering that the normative framework and public policies on the subject are still being built in Brazil. The deductive method and documentary research were applied, consulting not only the doctrine related to the topic, as well as Brazilian bills and international documents. A comparative study was also carried out between the Brazilian legislation and the European Union Act. The research concludes that there is pressure from large technology companies to change the bill or not be carried out in view of their immense profit with the use and sale of personal data. For this reason, the Brazilian authority must be severe in order to protect citizens and there is an urgent need to approve the Legal Framework of Artificial Intelligence.

Adotou-se por referencia o ato normativo europeu y o debate que está em tramitação no Poder Legislativo brasileiro, entre eles o Projeto de Lei 2.338/2023. El objetivo del texto es descubrir el panorama más reciente y relatar las preocupaciones existentes en cuanto a la protección de datos y ciudades en un nuevo escenario. Defende-se a importância de se inserir as tecnologias considerando o respeito ao ser humano, sob a perspectiva da filósofa Adela Cortina e do paradigma de gobernanza digital democrática. Realizou-se uma pesquisa exploratória, tendo em vista que o arcbouço normativo e de políticas públicas sobre o tema todavía está sendo construido no Brasil. Foi aplicado o método indutivo e pesquisa documental, consultando-se não somente a dutrina relativa al tópico, bem como projetos de lei brasileiros e documentos internacionais. También se elabora un estudio comparado entre la legislación brasileña y la norma de la Unión Europea. A pesquisa concluye que existe presión de las grandes empresas tecnológicas para que el proyecto de lei seja alterado ou não seja levado adiante tendo em vista su imenso lucro com a utilização e venda de dados pessoais. Por este motivo, una autoridad brasileña debe ser severa como el intuito de proteger las ciudades y tiene urgencia en aprobar el Marco Legal de Inteligencia Artificial.O artigo apresenta os resultados de pesquisa desenvolvida no período de setembro de 2023 a maio de 2024 que analisou o impacto das inteligências artificiais na vida atual e o seu impacto na gestão de cidades inteligentes.
