Clinical psychologists and the demands concerning parental disputes

Summary: Clinical psychologists are increasingly sought after by parents involved in child custody lawsuits, with allegations of parental alienation and / or child sexual abuse. In these situations, requests for psychological documents are common, which are invariably forwarded to justice. In addition to increasing procedural action, such documents have resulted in ethical complaints in the category councils, made by parents who feel demmage by its content. This essay aims to contribute from the theoretical, technical and ethical point of view of Psychology to discussions about documents produced by psychologists who work as clinical psychologists. Allied to the experience of the authors as forensic psychologists, is adopted the social critical approach. We note that the reduced involvement of those (s) professionals in the debates on post-divorce family makes practices in the area easy to reach of judicialization. Thus, we point out that the interdisciplinary dialogue is urgent and essential.

Por estas situaciones aumentan peticiones por documentos psicológicos, que invariablemente se remiten a los tribunales. Además de incrementar la acción procesal, dichos documentos han derivado en denuncias éticas en Consejos, realizadas por padres que se ven afectados por su contenido. Este ensayo objetiva contribuir con discusiones teórico, técnico y ético de la Psicología a los temas sobre la producción de documentos por psicólogos que trabajan en una práctica privada. Aliada a la experiencia de los autores como psicólogos jurídicos, se adopta la perspectiva social crítica de la Psicología Jurídica. Observamos que la menor implicación de esos profesionales en los debates sobre la familia post divorcio hace prácticas en el ámbito de fácil judicialización. Así, señalamos el diálogo interdisciplinario como urgente e imprescindible.Psicólogas(os) clínicas(os) são procuradas(os) com frequência por genitores envolvidos em processos judiciais sobre a guarda de filhos, com alegações de alienação parental e/ou abuso sexual infantil. Nessas situações, são comuns pedidos de documentos psicológicos, os quais, invariavelmente, são encaminhados à Justiça. Além de incrementar a lide processual, tais documentos têm resultado em denúncias éticas nos Conselhos de categoria, realizadas por genitores que se veem prejudicados por seu conteúdo. Neste ensaio, objetivamos contribuir do ponto de vista teórico, técnico e ético da Psicologia para discussões acerca da produção de documentos por psicólogas(os) que atuam em consultório privado. Aliada à experiência das autoras como psicólogas jurídicas, é adotada a perspectiva social crítica da Psicologia Jurídica. Constatamos que o reduzido envolvimento daquelas(es) profissionais nos debates sobre família pós-divórcio torna as práticas na área de fácil alcance da judicialização.
