Summary: The article analyzes the relationship between related contracts and arbitration clause. The central idea of the discussion is to verify if it is possible extend the arbitration clause contained in one of the contracts to another related contract that does not predict the submission of the dispute to arbitration. The work analyzes the doctrinal productions about the coalition, addressing are the causes for which such phenomenon occurs, and explaining the importance of a systematic interpretation of the coalition, a legal institute that takes into account the contractual cause. The article addresses the main characteristics of the arbitration clause, autonomy and consensualism, seeking to demonstrate how it would be possible to allow the extension of the arbitration clause even though the provision of the Arbitration Law that such agreement must be written (art. 4º, § 1º). At the end, two relevant cases on the subject judged by the Superior of Justice were analyzed. The methodology used was doctrinal research in comparison with a jurisprudential analysis, the latter from a qualitative choice. Based on the results obtained, the relevant and guiding elements for the solution of the problem of extending the arbitration clause to related contracts were identified.

El tema central en discusión es la posibilidad de extender la cláusula compromisoria contenida en uno de los contratos a otro contrato de coalición que no tenga la misma disposición para someter la disputa a arbitraje. El trabajo analiza cómo son las producciones doctrinales acerca de la coalición, abordando los fundamentos para que este fenómeno ocurra, y explica la importancia de una interpretación sistemática de la coalición, institución jurídica que lleva en cuenta la causa contractual. El artículo aborda las principales características de la cláusula compromisoria, esto es, la autonomía y el consensualismo, buscando demostrar cómo sería posible permitir la extensión de la cláusula compromisoria dado que la Ley de Arbitraje prevé que dicho acuerdo debe ser escrito (art. 4º, § 1). Al final, se analizan dos casos relevantes en la materia juzgados por la Corte Superior de Justicia. La metodología utilizada fue la investigación doctrinal en comparación con un análisis jurisprudencial, este último desde una elección cualitativa. Con los resultados obtenidos de la investigación se identificaron los elementos relevantes y orientadores para la solución del problema de la extensión de la cláusula compromisoria a los contratos conexos.O artigo busca analisar a relação entre os contratos coligados e a cláusula compromissória. A questão central posta em discussão é a possibilidade de extensão da cláusula compromissória contida em um dos contratos a outro contrato da coligação que não possui a mesma previsão de submissão do litígio à arbitragem. O trabalho analisa as produções doutrinárias a respeito da coligação, abordando quais são os fundamentos para que tal fenômeno ocorra, e explicitando a importância de uma interpretação sistemática da coligação, instituto jurídico que põe em evidência a causa contratual. O texto aborda as principais características da cláusula compromissória, isto é, a autonomia e o consensualismo, buscando demonstrar de que forma seria possível admitir a extensão de uma cláusula compromissória, dada a previsão da Lei de Arbitragem de que tal pactuação deve ser escrita (art. 4º, § 1º). Ao final, são analisados dois casos relevantes sobre o tema julgados pelo Superior Tribunal de Justiça. A metodologia utilizada foi a pesquisa doutrinária em cotejo com uma análise jurisprudencial, essa última a partir de uma eleição qualitativa.
