Summary: This article deals with the theme of the sources of the Personal Data Protection Law, an autonomous branch that has been developing with greater emphasis on Positive Law and Legal Science around the world in recent years, due to the technological advances that have enabled and promoted continued growth of cyberspace. The study covers both traditional sources of law, such as legislation, jurisprudence and custom, as well as non-state, transnational sources and contemporary practices, such as arbitration, corporate policies and codes, contractual clauses between multinationals and between agents in the cyberspace, Lex Privacy and technical and management standards for legal entities. The formulation and analysis of the set of sources of the Personal Data Protection Law constitute the bases of the architecture of this new area of Law. It was verified, in the study, that the classic legal sources, state and non-state, as well as contemporary sources are present in Brazilian Law, so that scholars, law enforcers and operators in general have a robust set of norms to resort to in order to promote the effective regulation of the protection of personal data, guided by the materialization of the fundamental rights of the holders together with the protection of legal certainty and the innovation factors that sustain today's informational societies.

El estudio abarca tanto las fuentes tradicionales del derecho, como la legislación, la jurisprudencia y la costumbre, como las fuentes transnacionales no estatales y las prácticas contemporáneas, como el arbitraje, las políticas y códigos corporativos, las cláusulas contractuales entre multinacionales y entre agentes del ciberespacio, Lex Privacidad y normas técnicas y de gestión para personas jurídicas. La formulación y análisis del conjunto de fuentes de la Ley de Protección de Datos Personales constituyen las bases de la arquitectura de esta nueva área del Derecho. Se verificó, en el estudio, que las fuentes jurídicas clásicas, estatales y no estatales, así como las fuentes contemporáneas están presentes en el derecho brasileño, de modo que los estudiosos, los agentes de la ley y los operadores en general tienen un conjunto robusto de normas para recurrir. a fin de promover la regulación efectiva de la protección de datos personales, guiada por la materialización de los derechos fundamentales de los titulares junto con la protección de la seguridad jurídica y los factores de innovación que sustentan las actuales sociedades de la información. O presente artigo aborda o tema das fontes do Direito da Proteção de Dados Pessoais, um ramo autônomo que vem se desenvolvendo com maior ênfase no Direito Positivo e na Ciência Jurídica em todo o mundo nos últimos anos, em virtude dos avanços tecnológicos que viabilizaram e promovem contínuo crescimento do ciberespaço. O estudo abrange tanto as fontes tradicionais do direito, como a legislação, a jurisprudência e o costume, quanto as fontes não estatais, transnacionais e práticas contemporâneas, como a arbitragem, as políticas e códigos corporativos, as cláusulas contratuais entre multinacionais e entre agentes no ciberespaço, a Lex Privacy e as normas técnicas e de gestão das pessoas jurídicas. A formulação e a análise do conjunto das fontes do Direito da Proteção de Dados Pessoais constituem as bases da arquitetura desta nova seara do Direito.
