Resumo: This thesis addresses the use of personal data as input in order to analyze the regulation and protection of the citizenship in a society, which makes use of technological surveillance. In addition to that, the influence of information and communication technologies on the economic development of society will be addressed together with some of the business models this economic development generates. These business models make use of personal data, which are valuable input for the so-called platform economy, in which they are used to influence users’ behavior inside and outside these platforms according to interest of the ones with access to them, which violates the users’ privacy. Finally, the current thesis investigates whether the Brazilian General Data Protection Law (LGPD) and the government agency Data Protection Supervisory Authority (ANPD) are able to protect the users’ privacy similarly to how the Code of Consumer Defense and Protection, a set of rules created to protect citizens in commercial transactions, protects the Brazilian citizens. The successful creation of the Code of Consumer Defense and Protection shows that it is possible to develop instruments to protect users and empower them to have control over their personal data, reducing the information asymmetry between users and the parties with access to their personal information.
