This work was based on a doctrinaire study and a jurisprudence research, focusing the central problem of the fulfillment of right to health through public social policies, with an emphasis on technological medicine. The right to health should be extended to all equally and with worthy conditions, through public social and economic policies with a preventive and a assistential aspect, in addition to popular participation as a democratic characteristic, with highlights on the social policies of sanitation and the Unified Health System (UHS). The subject is introduced, by analyzing the coverage of the right to health, as well as the human dignity, regarding not only to egalitarian, but also isonomic character that should be part of the right to health. The first chapter examines the fundamental right to health care, its international system of protection and its constitutional aspects. The second chapter studies the sanitary democracy and the prevention in public health. The third chapter, in turn, researches the public policy in brazilian health. The fourth chapter finally addresses the access to technological medicine through public policy. |
