This dissertation discusses the issue of the influence of Fake News on the conviction of the citizen-voter, which can result in changing the results of an electoral election, that is, directly interfering in the democratic health of a State. With a view to harmonizing freedom of expression and press with the democratic principle, a solution to this conflict is sought, through the analysis of mechanisms for controlling the veracity of information presented whether via the traditional press, or via the internet and mainly, social media. Considering this problem, it is worth asking how, and if, there are ways to reduce this practice that is harmful to democracy, through new specific legislation, mainly of an electoral nature, to try to curb the creation and proliferation of fake news. |
