Techniques of manipulation of deoxyribonucleic acid (DNA) associated with the development of the bioinformatics, enabled the creation of genetic-profile banks - created to investigate crimes. The use of such techniques is set on Act 12.654/2012 and on Decree 7.950/2013. These laws authorize judges to determine the gathering of genetic profiles when criminal identification is essential to the investigation of a crime. It also determines the obligation of biological material extraction and the registration of genetic profiles on databases where convicted criminals of felonies and heinous crimes are recorded. On the other hand, Decree 7.950/2013 established the Genetic Profiles National Bank and the Genetic Profiles Integrated Network - both bounded to the Justice Department - with the objective of store, share and compare genetic profile data. Since genetic data require a stronger legal guardianship - for they affect the deepest core of human intimacy - this study will seek to analyze the bioethical and legal matters raised by the adoption of such power instrument, as well as its social consequences. To do so, this study adopts a bibliographical methodology (used in a multidisciplinary perspective) and both deductive and inductive arguments. Dialectics will be used as research method, specifically to analyze conflicts evolving the adoption of criminal genetic profile database. The problems that such tool raises in Brazil will be analyzed under a critical focus, particularly to emphasize that violence will not diminish while criminality is seen as product of wickedness of criminals, whilst it is a result of inadequate social, cultural and economic structures. The importance of protection of countless constitutional and procedural rights will also be pointed out - especially those affected by Act 12.654/2012 - as well as the need to enhance the protection of the right to genetic intimacy in the era of comparable... |
