O PNE 2014 e a questão de gênero na educação: uma análise de sua repercussão no Estado Democrático de Direito Brasileiro

Resumo: The dissertation objective is to analyze the gender issue as a target of debates during the National Education Plan in 2014, likewise its reverberation in the social project provided in the Constitution of the Brazilian Federative Republic and the Democratic State of Law. The Federative Constitution of 1988 provides a Democratic State of Law accordingly established by the law. In the same Major Law, it is predicted the fundamental goals of the Federative Republic of Brazil which indicates the project of a materially egalitarian society. As comprehended that democracy will be attained through public policies made with the cooperation of all, respecting financial equality. Thus, the concept of deliberative democracy was chosen to guide the research. It is accorded to studies of the theory of communicative action by the philosopher Jürgen Habermas. Habermas believes the State must be guided by communicative procedural paradigm, which expects the participation of citizens spontaneously assembled to debate real-life situations in order to deliberate until reaching a mutual agreement to make laws that will be credulous and respected by everyone. Determined by this understanding a concept of public policy that is elaborated in a plural way will be presented. In a second juncture of the paper, the theme which involves gender will be explored over philosopher studies Nancy Fraser who embraces the same epistemological basis as Habermas. Thereupon, through the development of the theory of justice that pursues economic redistribution, cultural recognition, representation, or parity of participation. It will also defend democracy through the equal cooperation of all. At the end of the research, the 2014 NEP and the discussion that surrounded the gender issue will be explored over the methodology of analysis of speech. Thus, analyzing the different speeches presented during the formulation of the indicated public policy resulted in an exclusion of the word gender and the consequent replacement for another term from the original text of the bill. The exclusion of the word gender from the 2014 NEP reverberates on the non-execution in the social project constitutionally granting financial equality. In consequence, the disrespect for the Democratic State of Law from the logic of communicative action. In conjunction with the methodology of analysis of speech, the research will have a bibliographic analysis combined of doctrines, scientific articles in specialized journals, completion of course work, scientific thesis, and other studies available on the internet properly quoted and accredited by their authors, likewise document analyses, laws, bills, and media reports.
