Resumo: | This work aims to contribute to the construction of a local history in which a correlation between elements of justice and its penal framework is established, specifically the article 129 of the Brazilian Penal Code of 1940, with the verification of historical characteristics about the violent behavior of individuals who, for some reason, sat in the dock. In the course of the research we used 90 criminal cases under the typification of the referred article, judged in the Uberlândia region, Minas Gerais, from 1943 to 1953, and that are allocated by the History and Documentation Center of History Institute of Federal University of Uberlândia (CDHIS/INHIS/UFU). We verified from a quantitative and qualitative study that the legal norm presents a bilateral relationship with the individuals who are sub judice, sometimes being more influential than influenced, sometimes more influenced than influencers. With the data quantification, we can perceive the most recurrent characteristics of the defendant, trying to trace a pattern in such subjects and, through the qualification and careful reading of each case, it was possible to perceive other aspects as values and practices that are more linked to the history of each individual and the society in which he is found. In short, this research intends to contribute to the construction of a social history of Uberlândia by merging a historical-anthropological approach, verifying discourses and values of the direct parts of the criminal processes analyzed (defendants, victims and witnesses) or indirectly ones (lawyers, prosecutors and magistrates) |
