Autonomia para morrer: a universalização da ortotanásia como expressão de um direito à morte digna em face de uma cultura cosmopolita

Resumo: The emerging global society is responsible for creating a scenario of reconfigurations to old and new rights. In this challenge, is chosen the handling of end-of-life related rights, more precisely the establishment of a right to die in a natural and dignified form, through the universalization of the orthothanasia. In order to find the best way to the affirmation of that right, in a first moment, are presented the current concepts of the right of life, the right of human dignity and the right of autonomy, as well as the consequences of globalization upon them. In that manner, the study is started from a statement of the right of orthothanasia, guided by emerging bioethical assumptions. In a second moment, from the choice of orthothanasia as means to ensure that the worthy natural death procedure has been respected, the journey begins because of the need to turn effective such right. Thereby, the cosmopolitanism turns to serve as a contribution to the affirmation of a universal right of orthothanasia, contributing to the affirmation of a paradigm of opening State borders, of global dialogue and of respect to cultural relativism. Furthermore, it is taken ownership of the case of the boy Charlie Gard to demonstrate how society today (don't) understand the practice of orthothanasia, how the standardization of this right is necessary. To do so, the used approach method is the deductive, and the procedure method is historical, also the procedure used is the bibliographic analysis and the research technique used is of using research abstracts and booking. In accordance to the central idea of connection between national, international and transnational spheres, it is concluded that the high dependence of the assertion of a universal right of orthothanasia in order to ensure human dignity at end of life. However, whilst solidifying such projection of a global cultural cosmopolitanism, adding that the right of orthothanasia can be reached through Advance Directives will, once they are incorporated by national regulatory systems.
