“Autos de Habilitaçam” do século XVIII : análise filológica, terminológica e discursiva

Resumo: ABSTRACT The present work consists of philological, lexicological, terminological and legal discursive studies of manuscripts from the eighteenth century, dated 1789 and 1790, period of the lusitanian reign of D. Maria I, the Pious. The corpus is named Autos de Habilitação, a lawsuit which contains from the first petition to the final judgement, belonging to the Acervo Nacional da Torre do Tombo, in Lisbon, Portugal. The study of the corpus focused on the most relevant historical aspects of the colonial period of the lusitanian America and portuguese Empire concerning the importance of legal relations between family, society and law. Facsimile and semidiplomatic editions were made aiming at the recovery and the transcription of historical documents. Through codicological analysis, the study of the material used and the particularities of the manuscript was carried out. In addition, two functions of the philological activity were appraised, the adjective and the transcendent ones. The analysis of the adjective function aims at deducing what is not in the text, like autorship, date and biography of the author. The transcendent function perceives the text as an instrument that allows for the reconstitution of the cultural life of some people in a given period, contributing to the comprehension of the history and description of the regional language, transmission and preservation of this cultural heritage. The study of lexicology, specially of legal terminology, was carried out as to comprehend the legal language in the lexical-semantic field as a specialized corpus, in the legal environment of the eighteenth century. At last, the research addresses the interpretation and analysis of the data based on the legal discourse, through the perspective of Dominique Maingueneau’s scenography and ethos.The theoretical basis is also composed by Azevedo Filho (1987), Spina (1994), Cambraia (2005), Santiago-Almeida (2009), Maingueneau (2005, 2006, 2008), Amossy (2005), Biderman (1978, 1992, 2001), Krieger (2004), Finatto (2004), among others.
