The research starts from the vision of agrarian reform as a public policy for the reorganization of the Brazilian land structure, regional development and social assistance to its beneficiary. It presents the family farmer, the main actor of public policy, and his relationship with the land, characteristics and peculiarities as a way of life, in a perspective of the instrumental freedom proposed by Amartya Sen. Identifies the importance of the production of products by the settlers for sustainability in an agricultural model that combines production efficiency and protection of the environment. And in this context, the objective is the legal analysis of the certification of derived foods in retirement settlements, seeking legal solutions to the difficulties encountered by settlers in obtaining them. The research concludes with the indication of certification by audit as the most appropriate method for organ certification, made possible by a government partnership that already has precedents, without detriment to the participatory guarantee system, which requires legislative changes for better implementation.Methodologically, the study uses a legal-sociological approach, adopts bibliographic, documentary and field research, and has an exploratory and descriptive approach. The method used is the deductive method. |
