Resumo: | The aim of this study is to analyze the most updated conception of civil jurisdiction,conceived under the prism of the Constitutional State, the procedure inherent to it, oriented toefficiency and proportionality and how case management contribute to this conduct and, in theend, to what extent case management was introduced in Brazilian legal system. The conceptsof jurisdiction, reasonable duration of the process, efficiency, cooperation and proportionalitywere analyzed. An analysis of the English system and its case management techniques wasundertaken, as well as the analysis of the role of the parties and of the judge in implementingthese techniques. Lastly, it was sought to demonstrate the extent to which case management techniques are foreseen in Brazil and to define whether the Brazilian civil procedural system allows the adoption, in the first degree of jurisdiction, of a case management oriented to the efficiency and utility of the process. |
