Resumo: News reports about situations considered as racism are becoming more and more common in Brazil. However, these situations have not been qualified as racism by the justice. There seems to be a controversy regarding the meanings of what racism is between society and justice. Aside from the technical issues that integrate judges‟, sociologists‟ activities (and other professionals), how can the attribution of meanings be so different between justice and the concept more or less established by society? And for this matter, is there any difference at all? The purpose of this work is to present the types of social practices regarded as racial conflicts, discussed and sentenced in the Court of Justice of Minas Gerais, also which relations and agents are involved in them. Thus, this work intends to discuss the importance of the judiciary as the locus of resolution of these contends and, to understand by which means the justice defines racism and racial slur, ascribing meaning to those practices beyond what is described in the criminal offenses.
