Resumo: Marked in the confrontation between the participative aegis in the implementation of public policies, described in the Federal Constitution, and the regulatory structure of the Brazilian Public Administration, this dissertation analyzes societys role in the execution of the Action in Support of Projects for Infrastructure and Services (Proinf),under the perspective of the current legal framework. An action from Territorial and Regional Program, which designed the territorial approach for sustainable rural development in the contemporary implementation of public policies, Proinf incorporated into the executive process a stage of competence of the social agents of the Territory, adopting the consent of the Territorial Collegiate as a principle for thefinancing of rural infrastructure projects. Recognizing that Brazilian publicmanagement is structured in a legal framework of constitutional, infra-constitutional and infralegal norms which, by articulating hierarchically, regulate the acts of public agents for the execution of the state budget, the study was organized from literature review; the identification of the current regulatory architecture; the exploitation of theoperational process and the executive results of Proinf; and finished off in the direct investigation with managers and analysts from the 15 years of execution of the Action, and members of two Territorial Collegiate. In this context, it is inferred that the current legal framework refutes the participation of society in the execution of Proinf with a rigid framework of laws, decrees, ordinances and normative guidelines that do not register social intervention in the execution of the public budget.
