Resumo: The legal protection of the landscape in Brazil exists since the earlytwentieth century. It was not proposed, however, until the present day, a statutory legal concept that objectively allows the application of standards or which proposes new types of landscape, as the ordinary. Purpose - To propose, from the transdisciplinary scientific view of landscape, a legal concept that meets new social interests, to carry out the Law of Landscape in Brazil. To accomplish this goal, we sought to define the notion of concept, clarify the process of building and formation ofconcepts, analyze the existing key concepts of landscape and how legal protections are currently presented in the country. Methods - Qualitative research, with exploratory features, descriptive-analytical-oriented, through semi-structured interviews with open questions and oral consent of the interviewees. The subjects are 30 citizens in each of the five cities, one in each geographic region of Brazil where the protection of the landscape was the focus of federal lawsuits. Results -The respondents, for the most part, had a feeling about the landscape, without, however, be able to verbalize it in replies to questionnaires, through which relatedmostly landscape with nature. Conclusion - Brazil needs to create a legal concept of landscape that meets the technical factors and social interests, and linked to it, a plan of public policies. Proposed transposition of the presented concept in the European Convention of Landscape of 2000 and yet presented the proposal for a concept originated from studies conducted in the course of this thesis.
