This dissertation aims to understand the contribution of the principle-based model of judicial interpretation towards the effective implementation of social rights in contemporary society. This new model allows for a proactive role of both the judge and the society in promoting those rights stemming from norms with a low-density normative content. This New Constitutional Hermeneutics is characterized essentially by the supremacy of the Constitution and the normativity of principles, also developing from the contribution of the Philosophic Hermeneutics.
