A Doutrina dos Efeitos: uma solução para a inefetividade do Direito ao Trabalho Decente na era das transnacionais

Resumo: Despite all the efforts of the International Labour Organization (ILO) in the dissemination of the Decent Work, the world reality controlled by transnational corporations leads us to acknowledge the true ineffectiveness of Decent Work in global perspective. The protective framework created by regional and global protection systems of Human Rights have not shown enough to achieve the effective observance of the Decent Work. International Human Rights Laws, in particular those dealing with labor rights are inapplicable to non-State actors and, therefore, to large corporations. International Human Rights Laws only impose obligations on States and national laws are designed to operate only within the territories. Thus, the transnational operations of multinationals are not governed by international law, nor domestic laws. In addition, international standards dealing with the issue are mere standards. The effectiveness of Human Rights (in particular the Decent Work), i.e. the effective observance and application of the rule to concrete cases is dependent on their horizontal effectiveness, and therefore relies on the actions of individuals (natural persons or legal entities) and not exclusively on State performance. In this context, this paper seeks to highlight the situation of generalized ineffectiveness of Human Rights, especially the Decent Work (as a human right), studying the current protection systems and their weaknesses, in order first to propose a possible solution: the use of the Effects Doctrine as a form of transnational supervision of such rights, based on the performance of the States. Because it is essentially a theoretical research, the methodology to be used will consist of the collection and analysis of laws, norms and jurisprudence, as well as of obtaining indirect data, bibliographic studies and periodic examination and other news media. Furthermore, in addition, will be adopted methods of case studies, comparative study and interdisciplinary research.
