Preservação digital dos processos judiciais eletrônicos: políticas arquivísticas no Tribunal Regional do Trabalho da 3 ª Região, Minas Gerais

Resumo: Since the enactment of Amendment n. 45/2004, which regulated the reform of the judiciary, provided for in art. 5, LXXVIII, of the CF, the Judiciary has been unfolding to ensure greater procedural speed through instruments that make it possible to hasten and ensure the reasonable duration of the proceedings. The implantation of the PJe system stands out as the main measure to achieve this aim, since it is intended to use a single platform for the production and processing of digital-born legal processes in all spheres of the judiciary. The Labor Court, an important segment of the Judiciary Branch, is one of the pioneer branches in the use of software, currently counting on the implementation of the system in all Labor Regions components of its work structure. In this context, the research guiding problem was to examine the measures and policies adopted by the Judiciary to ensure the preservation of long-term judicial processes. From a case study at the Regional Labor Court of the Third Region, it was sought to highlight how the concern with preservation is felt and treated with regard to the evaluation criteria and the archivistical destination, the technological park and the storage policy. From a qualitative wedge investigation, we used the documentary research method to contextualize the TRT3ª and the bibliographic survey to deepen the questions related to the main preservation parameters translated into strategies, policies and reference models. Semi-structured interviews were used to capture the internal perception about the problematic in the organ and performed actions. We also used a question form as a complementary method to infer more specific queries related to the adherence of the PC to the preservation requirements of the Model Requirements for Computerized Process Management and Documents of the Judiciary (MOREQ-JUS). We have detected the absence of preservation, evaluation and disposal policies and practices related to the processes produced in digital media and a low adherence to the requirements of preservation of the listed in MOREQ-JUS. Faced with this worrying scenario, a proposal was presented to integrate the PJE into a digital repository.
