Resumo: Women's work is the theme of this dissertation, in which it is verified how Law followed the insertion of women in the labor market and if it has managed to promote women's work in order to emancipate it. Therefore, the study is divided into three parts. In the first, we analyze the configuration of the feminine labor from the French Revolution and Industrial Revolution, from the liberal state paradigm. In the second moment, the formation of the female labor force in Brazil after the Proclamation of the Republic is studied, based on legislation, case law and advertisements throughout the 20th century. The third part considers current legislation and jurisprudence regarding women's work. In the fourth part, the work of women in Brazil is analyzed in extreme situations: the woman involved in precarious work and the woman in positions of power. Throughout history, the law has sometimes failed to contemplate women in the realization of fundamental guarantees. But, as will be shown, it has an important role to play in the realization of the principle of equality between men and women.
