This project proposes a research over the rights of the homeless, one of the most violated population groups in their rights in our country, especially in their most fundamental rights and freedoms. Political conceptions influenced by market society perpetuate a perverse logic that maintains the violation of rights against the homeless. The maintenance and increase of this social phenomenon demonstrate this reality, since the form of tutelage conferred in different spheres actually do not develop emancipation nor recognize the autonomy. Based on the assumption that any society must settle rights, policies and legal protection from normative criteria established by emancipated individuals and with autonomy recognizing the possibility and the validity of its own construction in the social, legal and political fields - the proposed research intends to understand the needs of the homeless, from their own perspectives. Besides, it points out the importance of the recognition of these needs by the Legal System, through institutional action, taking into account the imperative assumption of the need to promote emancipation and autonomy of the individual. This work puts focus in one of the institutions of the Legal System that has been building specific action towards the homeless population: the Public Prosecutors Office with emphasis on the Public Prosecutors Office of the state of Minas Gerais.
