Resumo: The civilizational crisis of contemporary capitalism has relevant ecological expressions that require the examination of dynamics linked to it. This work seeks to contribute to investigations into the dynamics of appropriation of nature in contemporary Brazil and its relationship with the climate crisis. This investigation requires a recovery of Marx's formulations on the dynamics of the formation and development of capitalism and its effects on the set of ecological relations. Furthermore, the present work seeks in dependent and peripheral conditions to describe how the dynamics of the International Division of Labor affect socioeconomic relations in Brazil and consequently its relationship with nature. Based on the hypothesis that the general dynamics of capitalism and the particularities observed in peripheral countries result in an intense plundering of nature in Brazil, we examine the disputes surrounding the Temporal Framework as a legal thesis that restricts the possibility of demarcating indigenous lands in Brazil . In addition to the examinations indicated, this work examines legality based on Pashukanis' criticisms and the elaboration of the tactical use of law, based on the elaboration of Gustavo Seferian.
