The dissertation treats about the Law n° 10.639/03 that turns obligatory the teaching of the History and Afro-Brazilian Culture in the schools of the Basic Education. She represents a conquest of the claims of the black movement, however its approval only doesn t mean a change in the social relationship, to become necessary collective actions that guarantee its effectiveness in the education system. This study, is questioned, the absence of the policy too that it only isn t current government, but it is understood like a permanent and effective policy in education. For both it will be analyzed the public policy developed in the Maranhão State, it is considering the national policy of promotion of the racial equality in the extent of the education. So, it will be studied the black in the brazilian education; the actions o of the black movement on behalf of the education from a qualitative paradigm of the analysis, is building, thus, the object through the social research. The instruments used in research they were interviews with managers of the education policy of Maranhão, teachers of the state public net, technicians representatives of the Permanent Forum of Education and Ethnic-Racial Diversity, it is totaling fifteen voices that contributed to analysis of the policy actions of promotion of racial equality in education. Therefore, the implementation of the Law n° 10.639/03, in Maranhão, it is challenged the permanent public policies that they to ensure its effectiveness.
