The Brazilian Penal System, although it does not declare, has as its primary function the selection and exclusion of certain entities of society, which would characterize an abstract risk to the social structure defended by the State. The illusion of public security conferred by the State on society is used as a justification to segregate the individuals it considers dangerous, in the case of the patient in mental suffering that suffering is extended by their health conditions. Based on this problem, the present dissertation aims to conduct a case study on the security measures imposed by the Judiciary in the Region of Imperatriz / MA, based on the critical irrigation of the institute, in order to evaluate how the Executive Power propitiates the implementation of such measures. At the methodological level, using a quantitative approach, we chose to use methodological procedures such as bibliographic survey, semi-structured interviews, observation and documentary analysis, making it possible to make evident in practice the main incongruities faced by these patients facing the worst of the Criminal System cumulated with the worst of the Health System. |
