Resumo: The dissertation discusses the problem of the contradiction existing between the institute of the Security Measure, the current system surrounding periculosity, and the Brazilian Criminal Law in the Democratic Rule of Law. Applying the hypothetical-deductive method with a juridical scientific approach, its objective rests on demonstrating that the institute in question contradicts the theoretical basis of Criminal Law, in the ruling constitutional democratic order. Specifically, the research analyses the foundation to the notion of periculosity, rooted in Positivist Criminology’s etiological paradigm, and dissects the application of Security Measures in the Democratic State of Law, providing, as a result, that periculosity, as a foundational concept for applying security measures, presents several inconsistencies with the current system of Brazil's legal order, that limits the state's punitive power. At its end, it presents an illustrative empirical analysis of normative institutional dispositions and data, as well as a ruling on the subject.
