Resumo: This thesis aims to present a new way of hiring in the public sector with the private sector from the public - private partnerships as a public administration tool to promote the modernization of infrastructure, such as building ports, airports, railways, prisons, hospitals through private investors, but with a strong guarantor legislation profits on invested capital. It describes the state action process in the provision of Brazilian industrialization in the twentieth century from the transformation of public administration and the state itself. Next is performed a characterization of public - private partnerships from the examples of international and national experiences, noting the inclusion of the PPP model in the hiring of public administration as a consequence of the state's fiscal crisis. Finally seeks to highlight the state of the capture process by the private sector from the review of Law Nº 11.074/2004, together with the capital of the globalization process, raising doubts about the economic and social benefits of using this contracting model by public sector. Thus, an economic assessment of public-private partnerships will only be possible from a comparative analysis between the cost for the state to provide services and public infrastructure directly and cost of supply from public-private partnerships, however this analysis lacks data given the short time editing of Law Nº 11.079/2004, just turned 10 years.
