Uberização e a nova morfologia do trabalho: o caminho para um desenvolvimento tecnológico aliado ao valor social do trabalho

Resumo: The aim of this research is to discover which Labor Law’s defense mechanisms need to be activated, so that decent work, as a social value, starts to be respected in labor relations arising from the phenomenon of uberization. Therefore, it will be necessary to understand the history of both the Industrial Revolutions and the current state of the industry, the meaning of labor and its new morphology, the phenomenon of uberization and how it develops in Brazil. Then, it is analyzed how Brazilian law has been used to deal with the uberization of labor phenomenon, the incidence of fundamental rights from the social field in these work relations, the legislative measures that were created on this subject, the court decisions on the theme and Uber’s jurimetrics strategies used to develop jurisprudence. Bearing in mind that the historical and social analysis point to the importance of the participation by society, by international organizations and by the State to regulate the technology interventions on work, it is analyzed the measures of treatment for the presented problems, through proposals to be implemented through the International Labour Organization, trade unions and the Ministério Público do Trabalho. To develop this study, qualitative research is carried out, which also has a descriptive nature and pure results. Scientific articles, books, dissertations, data from research institutes, news, among other bibliographic sources were analyzed. This research focuses on the analysis of the Tribunal Superior do Trabalho decisions that dealt with labor relations arising from the uberization of work phenomenon, in the context of application-based ride services. It was analyzed the laws and bills that had the greatest impact on dealing with the app-based workers' relations.
