Direito à educação para adolescentes em situação de rua: entre representações, exigibilidade judicial e políticas públicas

Resumo: In this research, the goal is to investigate the effectiveness of the right to education for street adolescents. It is based on the many representations that the right to education assumes for this juvenile public with a view to achieving the possibilities of judicial and political enforceability in fulfilling the absolute priority established in the 1988 Constitution, the Convention on the Rights of the Child, of 1989, and in the Statute of the Child and Adolescent, Law nº 8.069, of 1990. It is assumed as a theoretical assumption that the street situation involves children and adolescents in a series of violations of their fundamental rights, and that education, primordial for the process of development and social insertion of children and adolescents and for the promotion of equality, integrates one of these rights. For that, a qualitative study was carried out through the technique of focus groups, in which ones adolescents who lived on the streets and who are part of the Gente Grande Project - which integrates the activities carried out by the O Pequeno Nazareno Association, an institution that specifically works in the care of street children and adolescents and their families. The activities of the Gente Grande Project aim to train apprentices and contribute to their insertion in the labor market and has as an initial target audience, adolescents - from 14 (fourteen) years - assisted by the hosting of the O Pequeno Nazareno Association. The results achieved in the research were treated based on what proposes Bardin's Content Analysis (2002), providing a broader degree of significance to the contents obtained and a fusion between the characters' speeches and the theoretical foundations of the research. Thus, there is a multiplicity of factors that contribute to the maintenance of the educational exclusion of these adolescents, denoting a joint absence of the State, the family and the society, which allows to conclude that, first, it is necessary to guarantee them not to live in the street
