One of the most current and contemporary themes in the field of democratic feminist criticism is the political participation of women and their legal protection. Based on the finding that, after 22 years of the establishment of the first affirmative policy for women in politics, statistics continue to indicate a framework of inequality between women and men, unlike other countries that adopted similar measures at the same time, - to understand the legal protection of women's political participation, both internationally and nationally, in order to analyze whether the model of legal protection adopted by Brazil is one of the causes for the persistence of this inequality. It was analyzed, firstly, what is political participation, how it manifests itself and its legal nature, how the evolution of the political participation of Brazilian women took place and if this participation occurs and, to what extent and proportion, both in the sphere of formal policy, as informal. Secondly, the main bottlenecks to the exercise of this participation in the scope in which it is still small and the legal, democratic and philosophical foundations for the specific protection of women in the exercise participation in politics. Later, has systematically analyzed the Brazilian model of protection of this legal good and, in categories, what forms of actions it adopts for defense and promotion, specifically, the political participation of women and the challenges to implement these actions. Later, a diagnosis of this model was made, in light of the data collected in the practice (TSE) and theory (literature) and it was found that, unlike the models adopted in other countries, it is insufficient in the defense and promotion of the good This is why, in the end, this research began to make normative proposals that could be adopted by the Brazilian State to strengthen the legal protection of the good under study. In order to reach the results, the research was divided into three phases, exploratory, described and normative, and qualitative analysis methods were used for data, bibliographies and referenced documents. The conclusion reached by this research was that, without effective advocacy of women's political participation in the formal (right-middle) framework, the process of gender equality (right-end) in politics will not be implemented. |
