Resumo: The Supreme Court is not the state institution most suited to exercising abstract control of constitutionality, not to be the most consistent democratic system. There are huge differences, and the Federal Constitution of 1988 does not, explicitly or implicitly, that such assignment, diffuse or concentrated form, can be remotely confused with the act of legislating. For this historical investigation of the development will be held in Brazil and in the West, the Constitutional States. After it will be argued that in a democratic state of Brazilian law, in addition to a more current concept of democracy and participatory democracy in the context of judicial review, is not enough the theory of tripartition of powers, but a plurality of principle of powers. This work investigates the mutual interference between process, Constitution, State and Democracy, especially with regard to judicial review under Brazilian law, in order to evidence that the constitutional jurisdiction is at the same time, a legal and political activity. This thesis will prove that the "judicialization of politics" is an existing process for a long time, and that will only increase. Without giving up the historical experience and examining the various theories about the legitimacy of constitutional jurisdiction, it is concluded that a Constitutional Court, as a body not part of the judiciary, but as another "power" of the state, will allow the participation of the greatest number can people through the process, the current open society.
