Although the right to housing is enshrined in article 6 of the Federal Constitution as a social right, and in addition to infra-constitutional legislation and international treaties on the subject, it is still not effectively fulfilled in many Brazilian cities. The aforementioned problem has as its precursor element the socioeconomic and urban development of Brazil. The lack of decent housing causes social and legal problems, as it prevents the enjoyment of other fundamental and social rights. The solution to this problem comes from the implementation of public policies that prioritize the protection of this right. However, the urban policies applied so far have as their main objective the acquisition of property, through mechanisms that lead to the commodification and financialization of housing and the indebtedness of the economically disadvantaged population. Thus, the purpose of the Dissertation is to assert about the right to housing and the need to use public policies aimed at the effectiveness of this right. Therefore, the Social Lease policy is analyzed, in order to understand if it represents a means capable of bringing effectiveness to the fundamental social right to housing. It was found that in relation to the low-income population, housing policies aimed at financing home ownership were not enough to guarantee the right to decent housing. In addition, the component of the housing deficit that increased the most until 2019 was related to the excessive cost of rent. Thus, it appears that a housing policy centered on the provision of housing through social leases may represent an alternative for the Public Power to contain the increase in the housing deficit. |
