Resumo: | The National Council of Justice influence the judgment of the improper conduct of roceedings in Brazil? The objective of this dissertation is to answer this question that research. For this test the hypothesis that after the creation of the National Council of Justice (CNJ), the misconduct cases were judged more quickly and severely. Methodologically, to meet the goal, we use descriptive statistics to demonstrate features of cases of improper conduct, including: the overall average time of processing of cases is 6 years; Alagoas is the slowest state with na average of 10 years, on the opposite side is Roraima with an average of 4 years. Judicial severity build a two-dimensional display, as follows: (1) size exclusion public administration and (2) financial dimension. In the first dimension, Alagoas is the most severe and Minas Gerais the less severe; in the second dimension, Roraima is the most severe, followed by Minas Gerais, Alagoas and is the least severe. To test the hypothesis we made use of multivariate statistics (t test for independent samples) whose result is: before the creation of CNJ average for handling a case of improper conduct in Brazil was 7.23 years after the creation of the CNJ the average became 3.70 years. As the severity, size exclusion of public administration increased from 0.053 before the CNJ to -0.140 after the CNJ; the financial dimension left before the CNJ 0.022 to -0.042 after the CNJ. The results in both dimensions were statistically significant. So we can say that the initial hypothesis was confirmed for display of speed and rejected the severity indicator. |
