This study, inserted in the contemporary criminal legal systems line of research from PUCRS Criminal Sciences postgraduate program, seeks to analyze the conflictive situation experienced by the contemporary society and its multiple contours determined by the emergence of new irreversible risks. That indicates we are in a period of transition, still without a safe definition of the paradigms that will endure. The goal is to evaluate the impact of the phenomenon of globalization, its implications on the human behavior and the repercussions to the Criminal Law, resulting in the appearance of a brand new criminality, with particular features. A Modern Criminal Law arises, guided by a new Criminal Policy that collides with historically constructed classic principles of limitation. The traditional liberal Criminal Law concepts demonstrate their lag to deal with the new demands. They are being reviewed in regards to this new social configuration, causing the confrontation of diverging doctrinal positions. The crisis faced by Criminal Law in contemporary society can be summarized by the difficulty of establishing its appropriate context of legitimacy. The development of proposals to face this issue necessarily involves the compliance of certain indispensable elements in a democratic State based upon the rule of law, especially linked to fundamental rights, among which stands out the human dignity. |
