Resumo: The current dissertation, which is associated to the research line of Contemporary Legal Systems, in the Post-graduation Program of the Criminal Sciences of Pontifícia Universidade Católica do Rio Grande do Sul, is a research whose main objective is to discuss the application of the effective constitutional principles, which are in the Democratic State of Law as well as in to the Police Investigation. The debate occurs, considering the legislative that is established in the article 155 of the Code of Criminal Procedure that foresees the possibility of the utilization of the informative elements which are in the Police Investigation, in order to give the background to the condemnatory decision, but they should not be the center of the investigation. In this context, there are the issues that are observed in the Court Jury, in which the juror, taking into consideration the principle of the inner conviction, is free to decide, based on any element, either processual or informative, without any substantial proves. Those decisions, that might mask the true, can condemn a person, grounded exclusively on the inquisitorial elements that were collected without the observation of the contradictory, and it is an affront to the guarantees that are ensured to the citizens by current the Federal Constitution.
