Cárcere feminino, direito à amamentação e a lei nº 11.942/2009 à luz dos princípios da humanidade e da pessoalidade da pena

Resumo: The discussion of this study focuses on Law No. 11,942/2009 of May 28th of 2009, which altered the texts of Articles 14, 83 and 89 of Law Number 7210 of July 11th of 1984 - Penal Execution Law to ensure the female prison minimum conditions of assistance to imprisoned mothers and their newborns during the period of breastfeeding and the study of the principles of humanity and personality of the punishment. The Law Number 11,942 / 2009 brought major changes to the Criminal Sentencing Act, which refers to: (i) assured medical care to women and newborns; (ii) provided spaces for prison nurseries cater for children of female prisoners during breastfeeding up to six (06) months of age; (iii) ensured the existence of section for pregnant and laboring women, as well as child care for children six (06) months and younger than 07 (seven) years of age to assist the helpless child, whose mother is serving a custodial sentence and (iv) ensured that the section and the nursery will be accompanied by qualified personnel, meeting the educational standards. This study aims to determine whether the principles of humanity and personality of the punishment were contemplated in the Law Number 11,942 / 2009, given the advances with respect to maternal and arrested his son, as well as the prediction of kindergarten and nursery areas, and also the possibility of extension of time children stay in prison until 07 (seven) incomplete years of age. Accordingly, we seek to analyze the female prison, especially with regard to the period of stay of children in prisons for exercising the right to breastfeeding, as well as assess whether the principles of humanity and personality of the punishment observed in the remaining Law Number 11,942/2009
