The miscarriages of justice seems to be a “minor” theme in Brazilian criminal procedural law, either because of the denialism of jurists who do not admit the possibility of making a mistake, or because of cynicism, or even because of the poor financial conditions of victims of errors to pay high attorney fees (not rare, poor, black, indigent, road freaks, sick, marginalized, etc.). Paradoxically, these are idealized as perennial and omnipresent concerns, frequently appearing in citations from the Digesto or from modern authors. In this sense, this thesis aims to interrogate miscarriages of justice, starting from the question: how miscarriages of justice have become a problem in current criminal procedure? The specific objectives are: (a) analyze the conditions of almost impossibility of miscarriages of justice before the appearance of a type of proof of innocence considered complete; (b) investigate the struggle of forces around the main purpose of the process (seeking truth vs. due process of law) of which the differential management of errors is one of the effects; and (c) explain current characteristics of differential error management. It starts from the hypothesis that the differential management of errors works like a magic cube that allows isolating, concealing, combining or completing the production of errors, created in response to the various movements of resistance to miscarriages of justice, which acquired new functions and objectives since the introduction of DNA tests in the penal system, around 1989. The preponderant time frame of the inquiry ranges from the 20th to the 21st century, despite the need to dedicate some jumps to the 13th to 19th centuries to demonstrate the impossibility of errors at that time. The method of approach is genealogical, situated at some point beyond or below the spectrum started with Nietzsche's creation and complemented by Foucauldian updating.
