Resumo: The present study has the aim to analyse the procedures and effects of the joint appeal by the extraordinary appeal and the special appeal. The Federal Constitution, dated October 5th, 1988, divided the former extraordinary appeal, creating the special appeal to protect the infra-constitutional law and the Superior Tribunal de Justiça as the court with competence to judge it. For this purpose, before investigating the subject matter of our study, we have made an essential introduction related to general considerations of the appeals, passing through the analysis of the courts of the National Judicial Power and the reasons for the creation of the Superior Tribunal de Justiça and the special appeal. Initially, we have examined the construction made by the Supremo Tribunal Federal, due to the lack of infra-constitutional statutes concerning the procedure of the joint appeal by the extraordinary appeal and the special appeal. Following, we discoursed about the basics appeals principles related to the joint appeal by the extraordinary appeal and the special appeal. We have deepened the study by fixing the nature of the judgment that authorizes the joint appeal by the extraordinary appeal and the special appeal. The legitimacy to appeal, in accordance to judgments that authorize double appealing by extraordinary appeal and the special appeal, has been exhausted evaluated. Moreover, we have identified, in light of statutes and principles, the order of the judgments of the extraordinary appeal and the special appeal and the possible prejudicial relation between them. Finally, due to the methodological rigor of the scientific study, we present the conclusions arisen during the essay.
